Lawsuit Against RCC Dismissed

I was very glad to read the report stating that the lawsuit filed against RCC by the family of George Smith was dismissed. To me, it seems that it could be termed a frivolous lawsuit, based on the reports of RCC's actions at the time of the event. I have to wonder if the Smiths are looking at RCC as having "deep pockets" that they are hoping to benefit from.
I also read that the family's attorney plans to appeal, and I really hope the appeal is denied.

A Miami judge has dismissed a lawsuit filed against Royal Caribbean International by the parents and sister of George A. Smith IV, the honeymooner who disappeared from a ship in July 2005. "We are pleased by the court's decision to dismiss the Smith lawsuit. For some time, we have said that a fair, accurate and objective review of the facts would clearly demonstrate that the lawsuit was completely baseless," Royal Caribbean said in a statement. "The court's decision upholds the validity of our position. Although we will not be surprised if the suit is refiled in some amended fashion, we are confident that the outcome will be the same. We continue to extend our sympathies to the Smith family for the tragic loss of their son." The suit was filed in July, shortly after Royal Caribbean reached a settlement with Smith's wife, Jennifer Hagel Smith. George Smith's parents and sister accused Royal Caribbean of inflicting emotional distress by attempting to cover up the disappearance. Royal Caribbean has said it fully cooperated with Turkish and U.S. authorities investigating Smith's disappearance from the Brilliance of the Seas near Turkey.
